Mom’s Heating & Cooling Privacy Policy

Effective Date: May 6, 2025

Introduction

Mom’s Heating & Cooling (“Mom’s,” “we,” “our,” or “us”) is committed to protecting your privacy. This Privacy Policy outlines how we collect, use, disclose, and safeguard your personal information when you interact with our services and website. By using our website or services, you consent to the collection, use, and disclosure of your information as described in this policy. We adhere to applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA), to ensure that your personal information is handled lawfully and securely.

Information We Collect

We may collect various types of information from you, including:

  • Personal Information: Information that you provide to us directly, such as your name, address, telephone number, email address, and other contact details when you request a service, schedule an in-home estimate, or otherwise communicate with us.

  • Usage Data: Information about how you access and use our website. This may include your IP address, browser type, device identifiers, pages visited, time spent on pages, and links clicked. We collect some of this data through cookies and similar tracking technologies (explained below) to understand website traffic and user interactions.

  • Other Information: Any other information you choose to provide to us (for example, information you include in a query or feedback form).

How We Use Your Information

We use the information we collect for purposes consistent with this Privacy Policy. These purposes include:

  • To Provide and Improve Services: We use personal information to schedule and provide our heating, cooling, and related services, to communicate with you about appointments or inquiries, and to improve our service offerings and website functionality.

  • To Communicate with You: We may use your contact information to respond to questions or requests, send confirmations and updates related to our services, and inform you of important changes or helpful information (e.g. maintenance tips).

  • Analytics and Service Enhancement: Usage data helps us analyze how our website and services are used so we can troubleshoot issues, perform data analytics, and enhance user experience.

  • **Advertising and Marketing: With your consent or as permitted by law, we use cookies and third-party tools to analyze visitor trends and measure the effectiveness of our marketing campaigns. For example, we use your usage data to deliver personalized or targeted advertisements for Mom’s on third-party platforms (such as showing our ads on Facebook/Instagram or Google to users who have visited our site). These tools enable automated ad targeting, retargeting (showing ads to you based on past interactions with our site), and performance tracking of our ads. (See Cookies and Online Advertising below for more detail.)

  • Legal Compliance and Protection: We may use your information to comply with applicable laws, regulations, and legal processes, and to protect our rights or the rights and safety of others (for example, to address fraud or security issues).

  • With Your Consent: We may use your information for any other purpose for which you specifically consent. If we seek to use your personal information for a new purpose not described in this policy, we will obtain your consent as required by law.

Cookies and Online Advertising

Cookies and Similar Technologies: Our website uses cookies, pixels, and similar tracking technologies to enhance your experience, gather analytics, and facilitate advertising. Cookies are small text files placed on your device when you visit a website, which allow the site or a third party to recognize your browser. We also use web beacons and pixels (such as the Meta Pixel) which work with cookies to transmit data. These technologies help us remember your preferences, understand how you use our site, and deliver relevant content and ads.

We utilize both first-party and third-party cookies for the following purposes:

  • Analytics (Performance Cookies): We use Google Analytics (including Google Analytics 4) to collect information about how visitors use our site. This tool uses its own cookies to collect data such as your IP address, browser type, device information, and browsing actions on our site. We receive aggregated statistical insights (for example, which pages are most visited, how users navigate the site) which help us improve website performance and content. Google Analytics may also set cookies to help distinguish unique users and throttle request rates. The data collected through Google Analytics does not directly identify you by name, but it may be considered personal information under privacy laws since it can include IP addresses and device identifiers. (For more details on how Google Analytics collects and processes data, please see Google’s Privacy Policy.)

  • Advertising (Targeting Cookies): We partner with third-party advertising platforms, including Google Ads and Meta Platforms (Facebook/Instagram), to display ads to you on their networks after you visit our site. These advertising partners use cookies and invisible pixels (e.g., the Meta Pixel on our site) to record information about your visit to our website and your interactions (such as pages viewed or actions taken). This practice, known as retargeting, allows us to share data with third parties and track users across the web for advertising purposes. For example, if you visit our website, you may later see an advertisement for Mom’s Heating & Cooling on Facebook or on a Google partner website. The information used for this includes online identifiers (like cookie IDs or device IDs) and details about your browsing activity on our site, which do not include your name or contact information but do track your device or browser. These third-party cookies also help us measure the performance of our ads – for instance, whether someone who saw an ad later contacted us or visited our site.

Data Sharing with Advertising Partners: When we use these analytics and advertising tools, third parties like Google and Meta may collect or receive certain information about your device and browsing actions through cookies/pixels integrated into our site. We do not share personal contact information (such as your name or email) for advertising, but the tracking technologies may enable these partners to link your site visit to other information they hold about you on their platforms. Any data that third-party advertising partners collect from our site will be used in accordance with their own privacy policies. For example, Google’s use of data from our site is governed by the Google Privacy Policy, and Facebook’s use of data is governed by the Meta (Facebook) Data Policy. We encourage you to review those policies to understand how they handle your information.

Your Consent for Cookies: On your first visit to our site (and periodically thereafter), you may see a notification about our use of cookies. By continuing to use our site, you are deemed to consent to the placement of cookies as described in this Policy (where your consent is required by law). You can withdraw or modify your consent at any time by adjusting your browser settings to block cookies or by using other opt-out mechanisms described in Your Choices below.

Third-Party Privacy and Liability: Please note that we do not control the data practices of third-party analytics and advertising providers. While we use these services to improve our offerings, the information collected by Google, Meta, and similar third parties is subject to their own privacy practices and is stored on their servers, not ours. We take care to partner with reputable companies and configure these tools in a privacy-conscious manner, but we are not responsible for the privacy practices or content of those third-party services or advertisements, and you engage with them at your own risk. Mom’s Heating & Cooling is not liable for any misuse of your personal information by these third parties, beyond the obligations we have to ensure they act as our service providers in accordance with applicable law. In other words, once data is collected by such third parties for their purposes, its security and use are governed by the third party. (For example, if Facebook or Google further processes the data for their analytics or ad targeting beyond our instructions, that processing is under their responsibility.) However, if you have concerns about data collected via our site’s integrations, you can contact us (see Contact Us below) and we will do our best to assist you.

Disclosure of Your Information

We do not sell your personal information. We only disclose or share your information in the following circumstances:

  • Service Providers: We may share personal information with third-party service providers who perform functions on our behalf. This includes companies that help us operate our business and the website, such as scheduling software providers, IT hosting services, email communication platforms, or contractors performing services for you on our behalf. These service providers are given access only to the information necessary to perform their functions and are contractually obligated to protect your information and use it only for our specified purposes.

  • Analytics and Advertising Partners: As noted above, we may allow third-party analytics and advertising partners (e.g., Google and Meta) to collect usage data on our site for analytics and targeted advertising purposes. This means we disclose (or permit the collection of) certain online identifiers and browsing information to these partners through cookies and pixels. Such sharing is done to help us understand website traffic and to reach you with relevant ads. We do not provide your personal contact information to these advertising partners without your consent; however, the cookies on our site may enable them to recognize you as a user on their platform. These third parties are considered “service providers” in terms of helping us with marketing and analytics, but they also use the information for their own services. We again note that their handling of the information is subject to their privacy policies, and we are not responsible for their independent data practices.

  • Legal Requirements: We may disclose your information if required by law, regulation, or legal process (for example, in response to a subpoena or court order). We may also disclose information in response to a request by a government authority or law enforcement, or to exercise or protect our legal rights (including enforcing our agreements or protecting the rights, property, or safety of Mom’s, our customers, or others).

  • Business Transfers: If Mom’s Heating & Cooling is involved in a merger, acquisition, financing due diligence, restructuring, bankruptcy, receivership, or sale of assets, your information may be transferred to a successor or affiliate as part of that transaction. In such cases, we will ensure the transferee agrees to protect your personal information in a manner consistent with this Privacy Policy.

Except for the scenarios above, we will not share your personal information with third parties without obtaining your consent.

Data Security

We implement appropriate technical and organizational security measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction. These measures include using secure servers, encryption of data transmissions (e.g., SSL/TLS for our website), and restricting access to personal data on a need-to-know basis. While we strive to protect your information, please be aware that no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security of your data; any transmission of information is at your own risk. We also recommend that you take steps to protect your own information, such as choosing strong passwords and not sharing your account credentials.

If we become aware of a data breach that compromises your personal information, we will notify you and the appropriate authorities as required by law.

Your Choices and Rights

We believe it is important that you remain in control of your personal information. Subject to certain exceptions under law, you have the following choices and rights:

  • Access and Correction: You have the right to request access to the personal information we hold about you and to request corrections of any inaccuracies. If you would like to review, update, or correct your information, please contact us using the information in the Contact Us section. We may need to verify your identity before fulfilling such requests.

  • Withdraw Consent: Where you have given consent for a specific use of your personal information (for example, for marketing or certain types of cookie data collection), you have the right to withdraw that consent at any time. Withdrawal of consent will not affect the lawfulness of any processing done prior to withdrawal, and it may be subject to legal or contractual restrictions (we will inform you if such restrictions apply). For example, you can withdraw your consent to marketing emails by unsubscribing, or withdraw consent to analytics/advertising cookies by disabling them as described below.

  • Cookie Controls: You can control or disable cookies at any time through your web browser settings. Most browsers allow you to refuse new cookies, delete existing cookies, or alert you when new cookies are being sent to your device. Please refer to your browser’s help section for instructions on how to do this. If you choose to disable or refuse cookies, please note that some features of our website (especially those that rely on cookies) may not function properly, and your experience may be affected. However, you will still be able to use our services even if you disable certain cookies (for instance, essential cookies that are necessary for site functionality cannot be turned off via our site).

  • Targeted Advertising Opt-Out: If you do not wish to receive targeted advertisements based on your visit to our site, you can opt out in several ways:

    • Meta (Facebook/Instagram) Ads: You can adjust your Facebook ad preferences to opt out of seeing targeted ads from us on Facebook or Instagram. This is done through your Facebook account settings (typically under Settings & Privacy > Ads). (Facebook Opt-out: Facebook Ad Preferences.)

    • Google Ads: You can opt out of Google’s personalized ads by visiting Google Ad Settings and switching off ad personalization. (You may need to be signed into your Google account for this to take full effect.) (Google Opt-out: Google Ads Settings.)

    • Industry Opt-Out Tools: You can also opt out of interest-based ads from certain participating companies through industry-wide tools. For example, the Digital Advertising Alliance of Canada (DAAC) and the Network Advertising Initiative (NAI) offer web pages where you can opt out of many targeted advertising cookies at once. To opt out of targeted ads from multiple ad networks, you can visit the DAA’s opt-out portal. (Note: opting out through these tools typically uses cookies to remember your choices, so if you clear your browser cookies, you may need to opt out again.)

  • Please note that even if you opt out of targeted advertising, you may still see non-personalized ads from us (or generic ads) that are not based on your past interactions.

  • Google Analytics Opt-Out: To prevent data from your visit from being used by Google Analytics, you can install the Google Analytics Opt-Out Browser Add-on. This tool, provided by Google, instructs Google Analytics JavaScript not to share information about your site visit. (This is a useful step if you want to maintain maximum privacy regarding analytics tracking.)

  • Marketing Communications: If you have subscribed to our newsletter or are receiving marketing emails or SMS from us, you can opt out at any time. To unsubscribe from email communications, click the “unsubscribe” link provided in any promotional email we send, or contact us directly requesting removal. To opt out of text messages, follow the instructions provided in the text (such as replying “STOP”) or contact us. Please note that even if you opt out of marketing messages, we may still send you transactional or service-related communications (for example, appointment confirmations or responses to inquiries) as those are not promotional.

  • Do Not Track Signals: Some web browsers offer a “Do Not Track” (“DNT”) feature that lets you signal a preference that your online activities not be tracked across different websites. At this time, our website does not respond to Do Not Track signals, and we do not alter our data collection practices when we detect a DNT signal from your browser. We adhere to the cookie and tracking practices described in this policy regardless of a DNT signal. If you wish to opt out of tracking, please use the cookie management and opt-out options described above.

  • Privacy Rights in Canada: In accordance with PIPEDA and applicable provincial laws, you have the right to inquire about our privacy practices and to challenge our compliance. You also have the right to lodge a complaint with the Office of the Privacy Commissioner of Canada or relevant provincial privacy regulator if you believe your personal information has been handled improperly. We invite you to contact us first with any concerns, and we will do our best to address them.

Children’s Privacy

Our services and website are not intended for individuals under the age of 13, and we do not knowingly collect personal information from children under 13. If you are under 13, please do not provide any personal information to us. In the event we learn that we have inadvertently collected personal information from a child under 13, we will promptly delete such information from our records. Parents or guardians who believe that we might have information about a child under 13 may contact us so we can investigate and remove any such data.

Changes to This Privacy Policy

We may update or revise this Privacy Policy from time to time to reflect changes in our practices, technology, legal obligations, or for other operational reasons. When we make changes, we will post the updated Privacy Policy on this page and update the Effective Date at the top. Any changes will become effective when posted. We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting and using your information. If we make material changes to how we handle personal information, we may also notify you by additional means (such as by email or with a notice on our homepage) if required by law. Your continued use of our services or website after any changes to this Privacy Policy constitutes acceptance of the updated terms.
